The firm was originally founded by Mark Wilson in San Jose, California, during the technology boom of 2000. In 2001, Thomas Ham joined Mark, after holding an in-house attorney position with a Fortune 500 company. Within just a few years, the law firm of Wilson & Ham enjoyed a very successful patent practice with several high technology clients in Silicon Valley and other areas throughout the nation.

In 2009, Wilson & Ham expanded to include Holman IP Law, which was founded by Jeff Holman in 2007 and offered a complementary patent practice based in Salt Lake City, Utah.
